LICENSE AGREEMENT OF THE NAVITRON CLOUD SYSTEM USER

LAN

IMPORTANT

This License Agreement of the NAVITRON CLOUD SYSTEM user (hereinafter referred to as LAN) is a legal agreement between you (BENEFICIARY) and Oki Doki Manufacturing Ltd. for the NAVITRON CLOUD SYSTEM that includes software and might include related physical support, printed materials and interactive or electronic documentation. Moreover, the NAVITRON CLOUD SYSTEM includes all updates and enhancements of the original software made by Oki Doki Manufacturing Ltd.

If you access or use the NAVITRON CLOUD SYSTEM in any way, you agree to comply with the LAN terms. Provided that you do not agree with the LAN terms, please do not access or use the NAVITRON CLOUD SYSTEM.

The use of the NAVITRON CLOUD SYSTEM on, at least, one of your computers means to understand and accept the provisions of this license agreement. The NAVITRON CLOUD SYSTEM can be used only based on the acceptance of all provisions stipulated under this document.

This LAN licenses the use of the NAVITRON CLOUD SYSTEM and contains explicit waivers as regards the warranty and responsibility.

DEFINITIONS

BROWSER
A web browser (commonly referred to as a browser) is a software application for retrieving, presenting, and traversing information resources on the World Wide Web.

PROXY
In computer networks, a proxy is a server (a computer system or an application) that acts as an intermediary between computers or other Internet connected devices and the Internet.

NAVITRON CLOUD SYSTEM
Is a multilingual system that removes or changes certain types of content from Internet pages. This software functions on the Internet and filters information. Its end is to remove information considered inappropriate for children, such as violence, pornography, aggression, drugs, religious cults, terrorism, gambling, online meetings/dates etc. NAVITRON CLOUD is based on a PROXY server, consisting of software that provides filtering services to the BROWSERS installed on the same computer or different computers.

BENEFICIARY
Any legal or natural person (kindergarten, school, library, institution, organization etc) that uses, accesses or interacts with the NAVITRON CLOUD SYSTEM.

COOKIE
Small amount of information sent in your BROWSER by a web server and stored on your computer's hard drive.

NAVITRON CLOUD LICENCE

The NAVITRON CLOUD SYSTEM is protected by copyright and other international copyright treaties, as well as any others intellectual property laws and treaties.

The NAVITRON CLOUD SYSTEM is not sold, but licensed. Oki Doki Manufacturing Ltd. does not sell (assigns) any right over the product, but grants to the LICENSE USER the right to use the system as per the terms of this LAN. Provided that you accept the terms of this LAN, you will automatically receive a license, granting you a non-exclusive right to use the NAVITRON CLOUD SYSTEM. Oki Doki Manufacturing Ltd. will keep its copyright and ownership right over the software, irrespective of its form or support. This LAN is not a resale of the original software or any of its copy.

1. LICENSING

This LAN gives you the following rights:

You can use, access or interact with the NAVITRON CLOUD SYSTEM on any number of computers, working stations, terminals, portable PCs, tablets, smart phones or other digital electronic devices (computers).

You can access or interact with any of the Internet domains associated to the NAVITRON CLOUD SYSTEM: www.navitron.net, www.cloud.navitron.net.

Reservation of rights

All rights that are not expressly given under this LAN are reserved by Oki Doki Manufacturing Ltd.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS

Trademarks

This LAN does not grant any right regarding any trademarks or services of Oki Doki Manufacturing Ltd.

Rental

You shall not distribute, rent, lease or lend the NAVITRON CLOUD SYSTEM.

Transfer

The initial license of the NAVITRON CLOUD SYSTEM does not allow a permanent transfer of this LAN to another end-user.

Cancellation

Without impairing other rights, Oki Doki Manufacturing Ltd. can cancel this LAN if you haven not complied with its clauses and terms. In such case, you must stop any use, accessing or interaction with the NAVITRON CLOUD SYSTEM on all computers, working stations, terminals, tablets, smart phones or other digital electronic devices.

Support Services

Oki Doki Manufacturing Ltd. offers support services for the NAVITRON CLOUD SYSTEM. The only support offered free of charge is the Q&A section from our website, www.navitron.net. Any software code or additional information provided as part of our Support Services will be subjected to the clauses and terms under this LAN. The technical information provided to Oki Doki Manufacturing Ltd. for the Support Services can be used by Oki Doki Manufacturing Ltd. to develop its products. Oki Doki Manufacturing Ltd. will not use such technical information as to allow your personal identification. In case of installation or operation malfunctions due or not to the LICENSE USER, they will be fixed by Oki Doki Manufacturing Ltd., on request at the Support Services.

3. UPGRADES

The NAVITRON CLOUD SYSTEM is constantly upgraded. All replacements, updates and enhancements of the original software, made by SC Oki Doki Manufactuirng SRL, are part of the NAVITRON CLOUD SYSTEM and will comply with the terms and conditions of this LAN. Therefore, the BENEFICIARY can use, access or interact with the NAVITRON CLOUD SYSTEM as per the terms hereby.

4. COPYRIGHT

All rights and copyrights related to the NAVITRON CLOUD SYSTEM (including without limitation all images, photographs, animations, videos, audios, music, texts and applets incorporated in the Software) and related materials are the property of Oki Doki Manufacturing Ltd. or its suppliers. All rights and intellectual property rights from and within the content, which can be accessed through the use of the NAVITRON CLOUD SYSTEM are the property of such content owner and can be protected by the applicable copyright and other intellectual property laws and treaties. This LAN does not grant any right to use such content. If the NAVITRON CLOUD SYSTEM provides only electronic documentation, you can print any number of copies of such electronic documentation. You may not copy the printed materials that come with the NAVITRON CLOUD SYSTEM.

5. USE OF COOKIES

As part of the support offered, Oki Doki Manufacturing Ltd. uses COOKIES to record information. Some sections from the following websites, www.navitron.net, www.cloud.navitron.net, can ask you to accept COOKIES. You may chose in this respect. If you change the settings of your BROWSER, you can choose to accept all COOKIES, to be warned when a COOKIE is installed or to refuse all COOKIES. If you choose to refuse all COOKIES, you cannot use the NAVITRON CLOUD SYSTEM.

6. CONFIDENTIALITY

Oki Doki Manufacturing Ltd. will not disclose the BENEFICIARY's personal data. Oki Doki Manufacturing Ltd. collects personal data and processes them only with your consent. Personal data are collected when you register on www.navitron.net for the use of the NAVITRON CLOUD SYSTEM. During your registration, Oki Doki Manufacturing Ltd. will ask for your name and email. Oki Doki Manufacturing Ltd. does not sell, exchange or rent personal data to third parties, but uses them only for the operation of the NAVITRON CLOUD SYSTEM. Oki Doki Manufacturing Ltd. can disclose your personal data as required by the law and when, in good faith, it considers that your personal data is required for the execution of an injunction.

7. FINAL PROVISIONS

THE NAVITRON CLOUD SYSTEM IS DELIVERED UNDER LICENCE "AS IS". NO IMPLICIT OR EXPRESS GUARANTEE IS GRANTED OR ACKNOWLEDGED, AS WELL AS NO CHANGES OR ADJUSTMENTS TO SERVE A PARTICULAR PURPOSE OR A PERSONAL SATISFACTION OF THE USER.

The NAVITRON CLOUD SYSTEM is delivered without guarantees. Oki Doki Manufacturing Ltd. does not guarantee, ensure or undertakes responsibilities for the operation and consequences of the use of the NAVITRON CLOUD SYSTEM or the software as regards the validity, loyalty, accuracy and fulfillment of the goals of the LICENSE USER. Oki Doki Manufacturing Ltd. will not be responsible for any direct, indirect, further or accidental damage arising from the use or inability to use the NAVITRON CLOUD SYSTEM.

It is highly advisable to test the NAVITRON CLOUD SYSTEM before its actual use. It is advisable to read about the operation of the NAVITRON CLOUD SYSTEM on www.navitron.net.

8. CERTIFICATION

Through the use, accessing or interaction with the NAVITRON SYSTEM, you attest that you have read this LAN, understood it and agreed to comply with all the terms and conditions stipulated hereby.
